Manuscript latin 3683 of the Bibliothèque nationale de France is a parchment manuscript from the mid-12th century, probably produced in the Abbey of Saint-Pierre in Moissac in south-western France. It contains Burchard's Liber decretorum.

Codicology

The manuscript consists of 160 folios, divided into 21 fascicles, mostly quaternions (see Dufour for further details), often bearing the catchword and measuring 360 x 235 mm. The layout is mainly full-page, except for the folios containing the indexes of the canons and part of the Book XX, which have a double-column mise-en-page; in both cases, there are 41 lines, and the ruling is drypoint. Blank folios: 76v, 83v, 106v, 112v, 121v, mostly148v.

The manuscript appears to have been written by a single copyist in praegothic script.

The decoration is very sober and consists of rubrics and small initials at the beginning of each canon, alternating in red and black. The initials at the beginning of each book are missing.

The description is partially taken from Dufour (1982, p. 163).

Burchard chapter fol. Significant Variants Literature
BU01.021 5v Between Cavendum et summopere […] per os dicat Gregorii and Et alibi. Dolens inquit […] diu stare non poterit is found the long version of the canon: Cur non videtur, cur non perpenditur quia benedictio illi in maledictionem convertitur, quia ad hoc ut fiat hęreticus ordinatur. Et item. Quisquis contra hanc simoniacam […] tantummodo inaniter concupiscit […] stare non poterit.

For the short version, see editio princeps fol. 3rb: Cur non perpendit, quia benedictio illi in maledictionem converitur.

BU01.023 5v There is an addition after c. 23. As in many Italian copies, in BnF lat. 3863 c. 23 is followed by Si quis episcopus aut presbiter aut abbas per pecuniam […] et sit anathema sicut Simon Magus a Petro.

In the editio princeps fol. 3va, c. 23 ends ... detestatio ne percussus, and c. 24 begins: Quod non oporteat ordinationes episcoporum diu differri. Quoniam quidam metropolitanorum quantum comperimus ne ...

Fransen, Montpellier p. 306
BU01.234 24v No additions after the end of book one (Quia vero [plurimi] episcoporum ex aliis […] est in troHadam).

See fol. 32r in the editio princeps.

Dusil, Wissensordnungen p. 257 n. 258
BU02.018-024 27rv C. 23 (De rebus vero illorum vel peculiari) is displaced, so that the sequence of canons is "18, 23, 19-22, 24". See fol. 36r-36v of the editio princeps for the standard sequence. Fransen, Montpellier pp. 301, 307; Galli/Rolker, Destroyed pp. 33–34; Gneckow, Abhängigkeiten p. 135
BU02.239 - end part 39r Standard end of Book II, but the last canon is numbered 238. See fol. 54r of the editio princeps for the ending of book two („Wormser Ordnung Typ A“).
BU03.015 41v Addition after c. 15 (see fol. 58r of the editio princeps), namely an excerpt from JE 1317 beginning Pervenit ad me quod and ending per clericorum ambitum destruantur. Fransen, Montpellier p. 306; Galli/Rolker, Destroyed pp. 44–45
BU03.241- end part 57r-58v After book three is added a synodal order. The most common one is Schneider's Ordo 5, but there is considerable variety, as Schneider's discussion of the individual ordines makes clear. See fol. 81 of the editio princeps for the ending of book three („Wormser Ordnung Typ A“).

BU08.038 80r BnF lat. 3863 break off with cohabitare tecto, not followed by spatium. See fol. 117v-118r of the editio princeps for c. 38, fol. 118r for c. 39, and fol. 119v for cc. 49-50. Fransen, Montpellier p. 303–304; Fransen, Valeur pp. 2, 9–10, 19; Galli/Rolker, Destroyed pp. 20, 49–53
BU08.049-50 80v The book resumes at c. 50 (errors in numbering) with the incipit Et ille que sanctimoniales.

Deteriores copies typically lack cc. 39-48; c. 49 may be incomplete or missing altogether. Sometimes, the two fragmentary canons cc. 38 and 49 are merged into one (grammatically disturbed) canon. See fol. 118r-119v of the editio princeps for a complete series of cc. 39-50.

Fransen, Montpellier p. 303–304; Fransen, Valeur pp. 2, 9–10, 19; Galli/Rolker, Destroyed pp. 20, 49–53
BU12.009 104r Here, c. 9 ends with similiter peniteat, see in the editio princeps fol. 154v. Fransen, Tradition pp. 116–117; Fransen, Valeur pp. 2, 10, 19; Galli/Rolker, Destroyed pp. 20, 49–53; Gneckow, Abhängigkeiten pp. 137-138, 155
BU12.010-20 104rv Lack of cc. 19-20, the others cc. 10-18 are present.

See the editio princeps fol. 156r.

c. 26 Si puella [...] is added in margin.

BU12.029 105r The canon is transmitted in a number of variants:
  • The phrase et post paululum is present
  • What is the wording between asserendi copia profluus and hęc in suis narrat affectibus? In BnF 3863: adserendi copia profluus etloquentię fructu fecundus hęc in suis narrat affectibus.
  • What is the wording between in malis promissis rescinde fidem and quod incaute novisti non facias? Here: in malis promissis rescinde fidem, in turpi voto, cave ut decretum quod incaute nisti non facias.
Fransen, Montpellier p. 304; Fransen, Tradition pp. 116–117; Fransen, Valeur pp. 12–13, 15–18; Hoffmann/Pokorny, Dekret pp. 61, 63–64
BU19.108 148r In deteriores copies, book 19 ends here (fol. 215r in the editio princeps). But in Bnf 3683 the Book XIX is almost complete: there is a lack of the last canon c. 159. Fransen, Montpellier pp. 304–305; Fransen, Valeur pp. 2, 10–11, 19; Galli/Rolker, Destroyed pp. 20, 49–53
BU20.057

BU20.093

106r c. 93 Omnis que secundum impulsu atque signorum. In deteriores copies, book 20 ends with c. 57, but here it ends at c. 100. c. 93 Omnis que secundum is interrupted at impulsu atque signorum. Lack of cc.94-95. Fransen, Montpellier p. 305; Fransen, Valeur pp. 2, 11; Galli/Rolker, Destroyed pp. 20, 49–53
After book 20 160v Book XX is probably incomplete: it ends abruptly in the middle of c. 100. See editio princeps fol. 236v. Rolker, Letters p. 112.- Jasper, MGH Conc. 8 pp. 24-26.
